Consignors Contract

1. CONSIGNOR agrees to consign or sell item(s) to Presque Isle Consignment, LLC at 2208 West 8 th Street, Erie, PA. Consignors warrants they possess complete and clear title to all merchandise offered and will NOT hold PI Consignment responsible for any claim from another party to offered merchandise. If an item is found by PI Consignment to be recalled, the consignor forfeits the item to be disposed of by PI Consignment without notice. PI Consignment reserves the right to decline or donate items (due to flaws found during pricing) at its own discretion.

2. RETAINED FEES FOR MERCHANDISE: Consignor receives fifty percent (50%) of the SELLING PRICE of each consigned item priced over $29.99 and forty (40%) on items priced $29.99 or less. This % does not include the buyer’s fee. (buyer’s fee is between .99 and 9.99 depending on price of the item and covers processing, staging and handling of items). The remaining portion shall be retained by PI Consignment, LLC. If PI Consignment must clean a consigned item a $5.00 charge will be incurred by the consignor and deducted from the consignor’s account for each item cleaned. If an item for consignment needs assembled a minimum of $20 will be charged to the consignor's account.

3. LIABILITY: While every reasonable effort will be made by PI Consignment, LLC to safeguard consigned merchandise at 2208 West 8 th Street, Erie, PA. PI Consignment assumes NO responsibility for the loss, damage to, or destruction of any consigned item(s) by fire, theft, accident, or any other cause.

4. PRICES: are set at the sole discretion of Presque Isle Consignment, LLC. All items are consigned for a period of nine (9) weeks once they go to the showroom floor for sale. This is when they will show up on your account. (This can take some time as we want to display your items in the best way possible) Items are consigned for 9 weeks and must stay for the duration of that 9 week period. Items reduce 20% after 4 weeks and another 20% after 7 weeks.

5. PICK-UPS: IF DESIRED, THE CONSIGNOR CAN CLAIM UNSOLD ITEMS, BUT IT IS THE SOLE RESPONSIBILITY OF THE CONSIGNOR TO RECLAIM THOSE ITEMS FIVE (5) CALENDAR DAYS OR LESS PRIOR TO THE EXPIRATION DATE.Presque Isle Consignment, LLC. will NOT notify the consignor prior to the expiration date on items priced $29.99 and under. They will automatically go to LAST CHANCE with an additional 30% off for 2 weeks and if they do not sell they will be donated. A courtesy call will be given for items over $29.99 and you will be asked if you want your item to go to LAST CHANCE (additional 30% off the item); If you want to donate the item, or pick up the item. After 9 weeks the item does become the property of Presque Isle Consignment, LLC.

6. CONSIGNOR PAYMENT: Payments are made to the listed consignor only. Checks are issued on the 15th day of the following month that your item sells. (It may take up to 10-15 Business days to reach you) A one dollar ($1.00) check fee is deducted from each check. Consignor forfeits any check payments not cashed within 180 days to Presque Isle Consignment, LLC. If the account balance is less than $21 the balance will continue to accrue until the next check date.. Consignor may use his/her/their account balance for store purchases at any time.

7. ACCOUNT TERMINATION: Accounts that have a two dollar (2.00) balance or less at the end of the year and having items left for sale are automatically closed. Consignors that cannot be contacted due to invalid address, phone or email forfeits his/her account balance to Presque Isle Consignment, LLC. Consignor that does not respond to a payout request (Made by phone) in the required time also forfeits his/her/their account balance to Presque Isle Consignment, LLC.

8. DISPUTES: All transactions and resolutions to disputes will take place in Erie, PA, USA.
